Botswana Public Service Unions Push Back: Proposed PSA Amendments Threaten Freedom of Association
A significant labor showdown is brewing in Botswana. The Progressive Public Service Recognized Trade Unions (PSRTU) have issued a formal, strongly worded response rejecting the Government’s urgent plan to amend the Public Service Act (PSA).
The Government’s Proposal
Through the Minister for State President and the Directorate of Public Service Management (DPSM), the Government proposed key amendments to the bargaining framework:
- Sole Bargaining Forum: The Public Service Bargaining Council (PSBC) and Sectoral Bargaining Councils would serve as the exclusive collective bargaining forums at national and sectoral levels.
- Mandatory Routing: All negotiations between the Government and recognized public service trade unions would be conducted exclusively via the PSBC or relevant Sectoral Bargaining Councils.
- Universal Binding Agreements: Collective labor agreements reached under the PSBC would have a binding effect across the entire bargaining unit—including non-members.
- Individual Autonomy: Unions would only retain autonomy to represent members on individual and internal organizational issues.
Why the Unions Are Vehemently Opposed
The Progressive Trade Unions argue that the proposed amendments undermine fundamental labor rights and international labor standards:
1. Violation of Freedom of Association & International Standards
- Voluntary vs. Mandatory: Union and PSBC memberships are strictly voluntary. Making PSBC decisions statutory and mandatory violates the right to self-determination and freedom of association.
- Breach of ILO Conventions: The unions state the amendments violate ILO Conventions 87, 98, and 151, as well as constitutional protections already guaranteed under Botswana Labour Laws.
2. Creation of a “Closed Shop” Environment
- Imposing PSBC agreements on non-members effectively forces a closed-shop system.
- Unions not affiliated with the PSBC would be stripped of their right to bargain collectively for their members.
3. Curtailing the Right to Strike
- Non-PSBC Unions: Stripping bargaining rights would effectively curtail non-member unions’ right to strike.
- PSBC Members: Even within the council, dissenting unions risk losing their individual voice and right to strike unless acting as a unified body.
The Unions’ Stance
“The Progressive Recognized Public Service Trade Unions are therefore vehemently opposed to the Botswana Government intention to amend the Public Service Act… Should the Botswana Government and its agents arrogantly go ahead, the Progressive Recognized Public Service Trade Unions shall take the necessary steps to restore the rights and dignity of Trade Unions and Workers.”
